You must accept all the following terms and conditions to use the software or any future updates. If you do not agree with any terms and conditions below, please do not use this software or its updates. Use of this software indicates your agreement to all the following terms and conditions. ‘IZI’.

 

Part I - Disclaimer

The software is provided to you free of charge. By law, you are entitled to guarantees, terms, and conditions that IZI cannot exclude or limit. In addition to those, IZI online services and

third-party online services provide software based on the current status. IZI and its suppliers do not make any guarantees, conditions, representations, warranties, or conditions (whether expressed or implied, based on status law, common law, practice, status, or any other reasons), including but not limited to performance, results, safety, non-infringement, merchantability, completeness, right to be left alone, quality satisfaction, and applicability to any particular purpose. This guarantee statement may be rejected in some countries. You may be entitled to rights and guarantees that cannot be waived or exempted. IZI does not limit the guarantee rights you are entitled to outside the limits of applicable law.

 

The exclusion and limitation of responsibility apply to the maximum allowable scope of the applicable law, even if remedial measures fail to play a role. IZI does not provide support services for the software.

 

Part II - Software License Agreement

Definition

"Software" means the name of the software, including all media associated with the software and documentation. It also includes all updates that have not been provided with separate terms and conditions to you.

 

Software License

If you obtain this software from IZI or its authorized personnel, as long as you follow the terms and conditions, you will be able to use the software for its intended purposes. If the software is designed to be used with another application software (the main program) released by IZI, and you have authorized permits provided by IZI, IZI grants you the non-exclusive licenses of the main program. In addition to the following provisions, IZI allows you to use this software under the user license agreement terms and conditions provided by IZI.

 

Intellectual Property Rights

IZI and its suppliers hold all intellectual property rights of the software. This software is not for sale, only for use under license. In addition to the explicitly granted rights, you should never install, copy, or use this software by any other methods. IZI and its suppliers retain all rights not expressly granted by the license.

 

Update Version

Using the updated version of the software means that you terminate all rights provided by its previous version. IZI may send the updated version to you according to different terms and conditions. This software may cause the computer to connect to the internet automatically and check for updates that can be downloaded to your computer.

 

The Internet Connection and Online Services

5.1  Automatically Connect to the Internet

This software may cause the computer to connect to the internet automatically, which will notify IZI once the software is installed successfully and get other services provided by IZI. The software may send the protocol address on your internet connection to IZI. The software will never send any personally identifiable information unless, in some jurisdictions, the internet protocol address is considered personally identifiable information.

 

5.2  Online Services Provided by Third Parties

This software allows you to access third-party websites and services conveniently (third-party online services). You are bound by the terms and conditions of the third party when you use third-party online services. IZI may at any time, for any reason, modify or cease to provide any third-party online services. IZI does not control, support, or take responsibility for third-party online services. Any transactions between you and a third party, including privacy policy, use of your personal information, payment, product and service delivery, and any other terms related to using third-party services are matters solely between you and the third party.

 

User Instruction

This software is free to use. You may enjoy the warranties, conditions, and terms that IZI cannot exclude or limit under the law. You agree that IZI will not make any express warranties about the software and that the software is provided "as is" without any warranty of any kind. IZI disclaims all warranties, either express or implied, concerning the software, including, but not limited to, the implied warranties of any kind for a particular purpose, merchantability, or non-infringement of the rights of third parties. The foregoing exclusions and limitations of liability are valid to the maximum extent permitted by applicable law, even if remedial actions do not function effectively. IZI does not provide support services for this software.

 

Limitation of Liability

7.1

In addition to the compensation that IZI cannot exclude or limit by law, in no event shall IZI, its affiliates, and suppliers be liable for any loss, damage, claim, or expense whatsoever, including any consequential, incidental, or consequential damages, except as may be excluded or limited by law, profit or savings, or for any damage caused as a result of business interruption, personal injury, or non-performance of care or third-party claims, even if IZI representatives have been advised of the possibility of such loss, damage, claim, or expense.

 

7.2

Under all circumstances, IZI, its associated companies, and suppliers’ collective responsibility and obligations are limited to the purchase price of this software (if any) in accordance with this

agreement or related to this agreement. Even in the case of a substantial or serious violation of this agreement or a substantial violation of terms and conditions, this limitation will still apply.

The provisions of this agreement do not limit the liability for death or personal injury caused by IZI's negligence or fraud. IZI denies, excludes, and restricts its obligations, warranties, and liabilities on behalf of its affiliates and suppliers but does not act on their behalf or for any other purpose. If your local law allows, the conditions of the foregoing limitation and exclusion may apply. This limitation of liability may be rejected in some countries. You are still entitled to consumer protection law and other laws that you are rightfully entitled to. IZI will not restrict the guarantee or compensation you are entitled to outside the scope of the law.

 

7.3

The IZI app flight logs and records are open for client browsing. However, flight records may not be used as a basis for claims against IZI and its affiliates. These foregoing restrictions and exclusions apply where local law permits. This limitation of liability may not be effective in some countries. Where applicable, you may have certain rights under the Consumer Protection Act and other such laws. IZI does not limit your warranty or indemnity to the extent permitted by applicable law.

 

General Provisions

Your rights to use the software will be terminated immediately if you do not comply with the terms of this agreement. If any provision of this agreement is found to be unenforceable, only that provision (and interpretation to the smallest possible extent) will be deemed unenforceable, and the remainder of this agreement will remain valid and enforceable in accordance with its terms. Article 8 shall remain in force after the termination of this agreement. This agreement will not undermine the legal rights of any consumer. This agreement shall be validated only in writing by the authorized officer of IZI. This agreement is a complete agreement between IZI and you regarding the software and supersedes any prior representations, discussions, undertakings, communications, or publicity relating to the software.
